Terms and Conditions of Use

These Terms and Conditions (“Terms”) govern your access to and use of the Gravity Human Performance LLC (“Company,” “we,” “our,” or “us”) programs through our mobile application and related services (the “App”). By downloading, installing, or using the App, you agree to comply with these Terms. If you do not agree, please do not use the App.

1. Subscription and Payments

1.1 App Store / Google Play Store

The App is available for free and may be download from the Apple App Store and Google Play Store.

1.2 Auto-Renewal

Subscriptions automatically renew each billing cycle on the anniversary of your initial enrollment.

1.3 Cancellation

You may cancel your subscription at any time. Upon cancellation, access to training programs will be revoked unless otherwise stated.

For alternative arrangements, contact matt@gravityhp.com at least 10 days before your renewal date. Include your registered email, profile name, and relevant details regarding your request.

1.4 Failed Payments

If a payment is declined, access to the App will be suspended until the outstanding balance is paid in full.

2. Use of Content

2.1 License

You are granted a limited, non-transferable, non-exclusive, license to access the training programs and content for personal use only.

2.2 Restrictions

Sharing login credentials or content with non-subscribers is strictly prohibited; such actions will result in immediate termination of your subscription without refund, and you may be held liable for damages to the maximum extent permitted by law.

Reproduction, distribution, or publication of any App content without prior written consent is not permitted.

2.3 Intellectual Property

All content, including programs, graphics, and written materials, is the exclusive property of Gravity Human Performance LLC and is protected by U.S. copyright and trademark laws.

3. Health Disclaimer & Assumption of Risk

3.1 Medical Disclaimer

All training programs are intended solely for general fitness guidance and do not constitute medical advice.

Signing our liability waiver prior to starting any of our training programs is mandatory. The waiver is provided electronically and your acknowledgement via the checkbox constitutes your agreement to the waiver terms & conditions.

Consult a licensed physician and obtain clearance before commencing any exercise program.

3.2 User Responsibility

Participation is at your own risk. If you experience pain, dizziness, or injury, discontinue use immediately and seek medical attention.

3.3 Liability Waiver

To the fullest extent permitted by law, Gravity Human Performance LLC disclaims liability for any injuries, health complications, or damages arising from participation in any company program.

4. Subscription Management

4.1 Monthly Subscriptions

Monthly subscriptions include all training programs, phases, blocks, and free content in our store. Your initial purchase of any program allows access to all of the others. For access to the programs you did not purchase directly, please reach out to matt@gravityhp.com and provide your App email address and profile name as well as the program(s) you are requesting access to and you will be granted access within three (3) business days.

4.2 Upgrades

Upgrading to personalized 1-on-1 coaching is available on on a case-by-case basis. Changes to your subscription take effect immediately, with applicable billing adjustments processed at the time of purchase.

4.3 Trial Periods

If a trial period is offered, your subscription will be billed beginning the day after the trial concludes, unless cancelled prior to its expiration.

Cancelling during the trial period will ensure no charges are incurred.

4.4 Refunds

Refund requests may be considered on a case-by-case basis. Please first contact matt@gravityhp.com with supporting details for your refund request. We reserve the right to offer a resolution specific to your request prior to issuing any refund in part or in whole. If a satisfactory resolution cannot be reached, a refund will be issued for the full amount paid less 3% for the original transaction fee.

5. Merchandise

Limited edition merchandise may be offered periodically. Orders are shipped from a 3rd party vendor we contract to produce the items. Shipping timelines may vary.

6. Cancellations

Subscriptions are billed on a rolling monthly basis with no minimum or maximum commitment.

No further charges will be applied after your cancellation is confirmed.

7. Updates to Terms

These Terms may be updated periodically.

You will be notified of any changes via the email associated with your account and updates will also be reflected within the App.

8. Governing Law

These Terms are governed by the laws of the State of Nevada, United States.

All disputes shall be resolved exclusively in the state or federal courts located in Clark County, Nevada.
